Plain-English note: These Terms contain important information about your rights and our responsibilities. Some sections limit liability only to the extent permitted by law, and do not affect rights that cannot be waived.

Québec residents: You acknowledge that the French version was made available to you first and that you have expressly chosen to be bound by the English version. If applicable law requires a particular language version to apply, that required version will apply.

1. Definitions

“Products”: any goods or items offered for sale on the Site, including (without limitation) cosmetic ingredients, DIY cosmetic and personal care accessories, tools and equipment, containers and packaging, wellness accessories, kits, bundles, samples, replacement parts, and any select ready-to-use personal care products.

“Services”: the Site, checkout, account features, content, educational materials, recipes and guides, subscriptions (if offered), customer support, and any other services or features we provide through the Site.

“Gift Cards”: prepaid value cards/vouchers redeemable on the Site, subject to any gift card terms shown at purchase.

“User Content”: reviews, comments, photos, videos, and other content you submit to Whisper of Botanicals.

“You” / “your”: the person using the Site or purchasing Products.

“DIY”: “Do-It-Yourself” — the creation, mixing, dilution, or preparation of personal care or cosmetic products by the customer using ingredients, tools, containers, or guides, including making blends, recipes, or formulations at home. DIY creations are made and used at your discretion, and results may vary based on ingredients chosen, concentrations, hygiene, storage, and individual sensitivities.

2. Who we are

Whisper of Botanicals (“we”, “us”, “our”) operates the Site and offers Products, Services and Gift Cards to customers in Canada.

3. Acceptance of these Terms

By accessing the Site, placing an order, or using our Services, you agree to these Terms and any policies referenced in them (together, the “Agreement”), including our Privacy Policy and any checkout-specific terms we present to you.

If you do not agree, do not use the Site.

4. Updates to these Terms

We may update these Terms from time to time. The updated version applies from the “Effective date” shown above.

Important: Changes will apply prospectively (going forward). Orders are generally governed by the Terms in effect at the time you place the order, unless applicable law requires otherwise.

5. Eligibility

You must be able to enter into a binding contract under applicable law to use the Site and purchase Products.

If you are under the age of majority where you live, a parent or legal guardian must place the order and accept these Terms on your behalf.

6. Intended use of Products; educational information (no medical advice)

Whisper of Botanicals offers cosmetic ingredients, accessories, containers, and educational information intended to support DIY cosmetic and personal care preparations.

Many Products sold on the Site are cosmetic ingredients or formulation components and are not finished consumer cosmetic products. Such ingredients may require dilution, blending, or proper formulation before safe use.

Our content (including recipes, guides, and product descriptions) is provided for general educational and informational purposes only.

We do not provide medical advice, diagnosis, or treatment.

Always patch test and follow safe handling instructions.

You are responsible for any preparations, blends, or formulations you create using our Products, including ingredient selection, concentrations, hygiene, storage, and use.

External use only: Unless a Product is explicitly labeled and marketed for another use, Products are intended for external cosmetic use only.

Do not ingest. Avoid contact with eyes and mucous membranes. Keep Products out of reach of children and pets.

If you have a medical condition, are pregnant or nursing, have allergies or sensitivities, or are unsure whether a Product is suitable for you, consult a qualified professional.

Canada-only intended market: Whisper of Botanicals Products are developed and offered for sale only in Canada. They are not intended for sale, distribution, or use in the United States or other jurisdictions, where regulatory requirements may differ.

7. Orders, pricing, and payment

7.1. Order acceptance

Your order is an offer to purchase. We may accept, reject, limit quantities, or cancel orders for any reason, including suspected fraud, inventory issues, export concerns, or pricing/technical errors.

An order confirmation email acknowledges receipt of your order but does not constitute acceptance. Acceptance occurs when we confirm shipment or otherwise confirm acceptance of your order.

7.2. Pricing

All prices are shown in Canadian Dollars (CAD) by default or the currency displayed at checkout. Taxes and shipping charges (if applicable) are shown before you submit payment.

Prices may change at any time before we accept your order. Once you place an order, the total price shown at checkout is the price you will pay if we accept the order. If we identify a pricing, description, or availability error after you submit your order, we will notify you promptly and may cancel the order and issue a full refund. Where permitted by law, we may also invite you to place a new order at the corrected price.

7.3. Payment

We accept payment methods shown at checkout. You authorize us (and our payment processors) to charge your selected payment method for your order, including applicable taxes and shipping.

7.4. Errors and corrections

We may correct errors on the Site (including pricing, availability, descriptions, and promotions) and may cancel or refuse orders impacted by such errors, with a refund where applicable.

8. Promotions and discount codes

Promotions (including giveaways, contests, referral programs, and discount codes) are subject to their stated terms and may be modified or ended at any time.

8.1. Discount codes

Discount codes may be limited to one per customer/order unless stated otherwise and may be restricted to specific products, time periods, or customers.

8.2. Giveaways, contests, and referrals

Each Promotion will be governed by separate rules/terms made available at the time of the Promotion. If there is any conflict between these Terms and a Promotion’s specific rules/terms, the Promotion-specific rules/terms will apply for that Promotion. Unless stated otherwise, Promotions are offered to eligible residents of Canada only; Québec residents may be excluded or subject to additional requirements where required by law.

9. Shipping, delivery, and risk of loss

9.1. Shipping destinations (Canada only)

We currently ship only within Canada (excluding any locations not supported at checkout). We do not ship internationally, including to the United States.

9.2. Address accuracy

You are responsible for providing a complete and accurate shipping address. If an order is returned due to an incorrect or incomplete address, you may be responsible for reasonable reshipping costs.

9.3. When risk of loss transfers

For consumer purchases, risk of loss transfers upon delivery to your designated address (or when you or an authorized recipient takes possession), except where applicable law provides otherwise.

9.4. Delivery confirmation and what “delivered” means

Carrier tracking and delivery confirmation may be used to determine whether delivery occurred. A shipment is considered delivered when tracking shows delivery to the address you provided at checkout, including delivery to a front door/porch, mailroom, reception/concierge, parcel locker, community mailbox, or other location the carrier treats as delivery for the selected service.

After a shipment is marked delivered, Whisper of Botanicals is not responsible for loss due to theft, removal, or misplacement from the delivery location, except where required by applicable law.

9.5. Lost or missing packages

If your tracking shows delivered but you cannot locate the package, contact us promptly so we can assist with reasonable steps (for example, carrier inquiry). Outcomes may depend on carrier results and applicable law.

9.6. Signature / high-value shipments

For certain orders (for example, high-value shipments), we may require a signature or use a delivery service level we consider appropriate.

9.7. Remote and extended delivery areas

Some remote, rural, island, ferry-access, or extended delivery locations in Canada may involve higher shipping costs or longer delivery times.

Where carrier rates for a destination substantially exceed the standard shipping amount charged at checkout, Whisper of Botanicals reserves the right to contact you prior to shipment to request an additional shipping fee or to cancel the order and issue a full refund.

10. Temperature-sensitive products and shipping conditions

Some products may be sensitive to heat, cold, humidity, or transit conditions. Shipping exposure is outside our control, and Products may change appearance/texture in transit without being defective.

Nothing in this section limits your remedies for Products that are defective when shipped or that fail to meet statutory guarantees where those guarantees apply.

11. Returns, exchanges, and hygiene-sensitive products

Because many Products are cosmetic ingredients and personal care items, we generally do not accept returns or exchanges for hygiene and safety reasons.

This does not limit your rights for defective goods or other non-waivable statutory remedies.

11.1. Wrong item / missing item / damaged in transit

If your order arrives with a wrong item, missing item, or shipping damage, contact us promptly with:

• order number
• clear photos (outer box, inner packaging, and affected product)

Recommended notice windows (to help us investigate quickly):

• Visible shipping damage: within 48 hours of delivery
• Concealed damage: within 7 days of delivery
  Late notice may limit our ability to investigate and may affect the remedy, subject to applicable law.

11.2. Defective products

If a Product appears defective upon receipt (for example, leakage due to packaging failure), contact us promptly and we will work with you on an appropriate remedy, subject to applicable law.

11.3. Remedies

Where a remedy is available, we may (as appropriate):

• replace the item,
• reship the affected item(s), and/or
• issue a refund/credit for the affected item(s).
  Refunds (if issued) will be processed to the original payment method within a reasonable time, typically within 5–10 business days, depending on the payment provider.

12. Canada-only sales, freight forwarders, reshippers, and exports

Whisper of Botanicals offers Products for purchase and delivery only within Canada. The Site and Products are not intended for marketing, use or sale outside Canada.

12.1. No international sales; no U.S. sales

We do not sell or ship Products to addresses outside Canada, including the United States. If you attempt to purchase for delivery outside Canada, we may refuse or cancel the order.

If you access the Site from outside Canada, you do so on your own initiative and are responsible for complying with local laws. Whisper of Botanicals makes no representation that the Site or Products are appropriate or available for use outside Canada.

12.2. Orders to freight forwarders

If we reasonably believe an order is intended for export through a freight forwarder, reshipper, or mail-forwarding service, we may refuse or cancel the order prior to shipment.

12.3. Delivery to forwarding services

If you provide a Canadian address that is a freight forwarder/reshipper/mail-forwarding service, and we deliver to that address, delivery is deemed completed at that address. After delivery to that address, we are not responsible for loss, damage, delays, seizures, duties, taxes, penalties, fees, foreign compliance issues, or any claims arising from use, resale, or distribution outside Canada.

Nothing in these Terms limits remedies that cannot be limited under applicable law.

13. Ingredients, safety, and customer responsibilities

You agree that you will:

• read product pages and instructions;
• patch test before use;
• use clean tools and safe handling practices;
• follow recommended storage guidance;
• discontinue use if irritation occurs;
• keep Products out of reach of children and pets; and
• avoid use if you have known sensitivities, and seek professional advice when appropriate.

Some ingredients may not be suitable for all skin types or conditions. When in doubt, consult a qualified professional.

Certain ingredients (for example essential oils, acids, and active cosmetic ingredients) may cause irritation or adverse reactions if improperly diluted or used.

Whisper of Botanicals does not supervise or control how Products are combined, diluted, stored, or used once delivered. You assume full responsibility for any formulations, mixtures, or preparations you create using our Products.

14. Subscriptions or recurring orders (if offered)

If we offer subscription purchases, the specific terms (billing frequency, cancellation, etc.) will be displayed at checkout and in your order confirmation. You may cancel in accordance with those terms, subject to applicable law.

15. Accounts and acceptable use

You agree not to misuse the Site, including by:

• attempting unauthorized access;
• interfering with Site security or operation;
• using the Site for unlawful purposes; or
• posting unlawful, infringing, or harmful content.

We may suspend or terminate access to the Site for suspected misuse, fraud, or unlawful activity, subject to applicable law.

16. Intellectual property

All content on the Site (including text, images, branding, and designs) is owned by Whisper of Botanicals or its licensors and is protected by applicable intellectual property laws. You may not copy or use it without permission except as allowed by law.

17. User Content (reviews, photos, videos)

If you submit User Content, you grant Whisper of Botanicals a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display that User Content for business purposes, including marketing.

To the extent permitted by law, you also waive any moral rights you may have in your User Content (or agree not to assert them) insofar as necessary for Whisper of Botanicals to use the User Content for the purposes described above.

17.1. Your responsibilities

You represent that:

• you own or have permission to submit the User Content;
• the User Content does not violate any law or third-party rights; and
• if your User Content includes an identifiable person, you have their consent for Whisper of Botanicals to use it for commercial/marketing purposes.
  We may remove User Content at our discretion.

18. Third-party services

The Site may use third-party services (payment processors, shipping carriers, analytics tools). Those services may have their own terms and privacy practices. Whisper of Botanicals is not responsible for third-party services outside our control, subject to applicable law.

19. Recalls and safety notices

If a Product is subject to a recall or safety notice, you agree to follow the instructions we provide (or those provided by the manufacturer or regulator). Remedies will be provided as required by applicable law.

You agree to provide accurate contact information so we can notify you of recalls or safety updates.

20. Chargebacks, fraud, and disputes

If you file a chargeback or payment dispute, we may provide relevant information to the payment processor (such as proof of delivery, order details, and communications). Where permitted by law, we may suspend or limit your ability to place further orders in cases of suspected fraud or abuse.

21. Disclaimers

To the fullest extent permitted by law:

• The Site and Services are provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted or error-free operation.

Consumer rights: Some jurisdictions do not allow certain disclaimers. Where prohibited, these disclaimers do not apply to you.

22. Limitation of liability

To the fullest extent permitted by law:

• Whisper of Botanicals will not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits), even if advised of the possibility.
• Whisper of Botanicals’s total liability relating to an order or Product will not exceed the amount you paid for the specific Product(s) giving rise to the claim.

This limitation applies regardless of the form of action (contract, negligence, statutory claim, or otherwise).

22.1. Non-excludable liability and statutory rights

Nothing in these Terms limits or excludes liability, warranties, remedies, or consumer protection rights that cannot be limited or excluded by law. Where limitations are not permitted, they do not apply.

23. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold Whisper of Botanicals harmless from claims arising out of your misuse of the Site, violation of these Terms, or unlawful/infringing User Content.

24. Privacy

Your use of the Site is also governed by our Privacy Policy.

25. Governing law and venue

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute will be brought in the courts located in British Columbia, unless consumer protection laws give you the right to bring a claim in your home province or territory.

26. Force majeure

Whisper of Botanicals is not responsible for delays or failures caused by events beyond our reasonable control, including (without limitation) natural disasters, severe weather, fires, pandemics, strikes, supply chain disruptions, carrier delays, internet/service outages, or governmental actions. This does not limit any non-waivable consumer rights.

27. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

28. Entire agreement

These Terms, together with referenced policies and any terms presented at checkout, are the entire agreement between you and Whisper of Botanicals regarding use of the Site and purchases.
