1. Overview and Acceptance

The Whisper of Botanicals Referral Program (the “Program”) allows eligible existing customers to introduce new customers to Whisper of Botanicals and earn promotional rewards when the conditions set out below are met.

The Program is operated by Whisper of Botanicals Inc. (“Whisper of Botanicals,” “we,” “us,” or “our”), a corporation registered in British Columbia, Canada.

These Referral Program Terms & Conditions (“Program Terms”) supplement our Terms of Service & Sale and Privacy Policy.

By participating in the Program, participants agree to these Program Terms. Where these Program Terms conflict with our general Terms of Service & Sale concerning the Program, these specific Program Terms prevail, subject to applicable law.

Participation as a Referrer is strictly reserved for existing Whisper of Botanicals customers who have previously placed at least one valid, paid order.

New customers may receive a promotional discount through a qualifying referral, subject to the eligibility and claim requirements described below.

2. Definitions

For the purposes of these Program Terms:

Referrer: An eligible existing Whisper of Botanicals customer who shares a personalized Referral Link.
Referred Customer: A new customer who receives a referral invitation and claims the associated promotional discount.
Qualifying Purchase: A valid first purchase made by a Referred Customer that satisfies the Program's eligibility, payment, and referral requirements.
Friend Discount: A promotional discount of 15% offered to an eligible Referred Customer on their first purchase.
Referrer Reward: A promotional coupon providing 15% off a subsequent eligible purchase, issued following a successful referral.
Referral Link: A personalized link generated through the Program and associated with an eligible Referrer.
Referral Code: A promotional code generated through the Program in connection with a referral.
Claiming a Discount: Entering an email address and submitting the referral reward claim form to obtain a Friend Discount.
Newsletter: Promotional email communications from Whisper of Botanicals, including product news, educational content, special offers, and other marketing updates.
Site: whisperofbotanicals.ca.

All monetary amounts are expressed in Canadian dollars (CAD), unless otherwise stated.

3. Eligibility

3.1 Referrer Eligibility

To participate as a Referrer, an individual must:

Have previously placed at least one valid, paid order with Whisper of Botanicals that has not been cancelled or fully refunded.
Reside in Canada and have reached the age of majority in their province or territory of residence.
Provide accurate registration and account information.
Participate for legitimate referral purposes.
Comply with these Program Terms and applicable laws.

The qualifying previous purchase must have occurred before the individual begins participating as a Referrer.

Creating an account, registering for the Program, or obtaining a Referral Link without a previous qualifying purchase does not establish eligibility to earn Referrer Rewards.

We may verify purchase history and refuse or revoke rewards attributed to participants who did not satisfy these requirements.

3.2 Referred Customer Eligibility

The Friend Discount is reserved for genuine first-time customers.

Individuals who have previously completed a valid purchase from Whisper of Botanicals are not eligible for a Friend Discount, including when they use another email address, identity, or customer account.

Referred Customers must have a Canadian delivery destination supported by our checkout.

We may exclude our employees, owners, contractors acting on our behalf, commercial resellers, and participants in separate affiliate arrangements unless expressly authorized.

Eligibility may be verified using reasonably necessary customer, order, payment, and fraud-prevention information.

4. Friend Discount — 15% Off

An eligible Referred Customer may receive:

15% off their first qualifying purchase from Whisper of Botanicals.

To receive the Friend Discount, the Referred Customer must:

Receive a valid Referral Link or invitation from an eligible Referrer.
Follow the Referral Link to the reward claim form.
Provide a valid email address and submit the form to claim their promotional code.
Agree to the Program Terms and the newsletter subscription information disclosed in the reward claim form.
Apply the valid Referral Code during checkout.
Successfully complete their first eligible purchase.

4.1 Newsletter Subscription When Claiming a Discount

Claiming a Friend Discount through the referral reward claim form also registers the Referred Customer for the Whisper of Botanicals newsletter, as disclosed at the time of the claim.

The disclosure presented with the claim form explains that, by claiming the code, the individual accepts these Program Terms and subscribes to promotional email communications from Whisper of Botanicals.

The newsletter may include product announcements, educational content, new releases, promotions, and special offers.

Newsletter communications are managed in accordance with our Privacy Policy and applicable law.

Subscribers may unsubscribe at any time, using the unsubscribe mechanism provided in promotional emails or by contacting Customer Service.

Unsubscribing does not, by itself, invalidate a legitimately issued and otherwise valid Friend Discount.

Merely receiving an invitation, following a Referral Link, or viewing the reward claim form does not constitute a newsletter subscription. The subscription described here relates specifically to submission of the reward claim form.

4.2 Discount Conditions

No minimum purchase amount is required.

The Friend Discount applies to eligible merchandise only, excluding taxes, shipping charges, gift cards, and other ineligible items or charges.

The Friend Discount:

Is available only to genuine first-time customers.
Can be redeemed once per eligible customer.
Cannot be exchanged for cash, gift cards, or store credit.
Cannot be applied retroactively to completed purchases.
Cannot be combined with other promotional discounts unless expressly authorized.
Is subject to the expiration date and redemption conditions communicated when the code is issued.

Creating additional accounts or using alternative personal information does not establish a new entitlement.

Applicable taxes and shipping charges remain payable as calculated at checkout.

5. Referrer Reward — 15% Off

For each successful, verified referral, an eligible Referrer receives:

One unique promotional coupon providing 15% off a subsequent eligible order from Whisper of Botanicals.

The following conditions apply:

Each distinct, successful qualifying referral earns one Referrer Reward.
Multiple successful referrals may generate multiple independent reward coupons.
No fixed overall limit applies to legitimate referrals unless a reasonable restriction is announced prospectively.
Each reward coupon can be redeemed once only.
Only one Referrer Reward coupon may be redeemed per order.
Reward coupons cannot be combined with one another or with other promotional discounts.
No minimum purchase amount is required to redeem a Referrer Reward.
Discounts apply to eligible merchandise only, excluding taxes, shipping charges, gift cards, and other ineligible items.
Reward coupons have no cash redemption value and cannot be exchanged for money or store credit.
Reward coupons are personal to the recipient and may not be sold, assigned, or transferred.

5.1 Reward Validity

Each Referrer Reward coupon is valid for 365 calendar days from its date of issuance.

The validity period begins when the coupon is issued following approval of the qualifying referral, not when the Referred Customer places their order.

The expiration date is communicated when the coupon is issued.

Each coupon is independent. Receiving another reward does not cancel, replace, or extend the validity of an existing coupon.

6. Successful Referrals and Reward Approval

A referral is successful only when all applicable eligibility and purchase requirements are met.

The Referrer must have completed a qualifying previous purchase before participating in the Program.

The Referred Customer must normally apply their Referral Code during checkout for the referral to qualify.

Following a Referral Link, viewing the Site, or claiming a discount without completing a qualifying purchase does not, by itself, earn a Referrer Reward.

Only one Referrer may receive credit for a particular Referred Customer's qualifying first purchase. Attribution is normally determined by the valid Referral Code redeemed and recorded by our systems.

There is no minimum monetary threshold for a Qualifying Purchase. The Referred Customer must nevertheless complete a genuine, successfully paid purchase of eligible merchandise.

6.1 Reward Approval Period

Referrer Rewards are normally approved and issued 15 calendar days after the Referred Customer's qualifying purchase, provided the order remains eligible and passes verification.

We may reasonably delay approval to investigate payment issues, suspected fraud, cancellations, refunds, chargebacks, or other material eligibility concerns.

Cancelled, fully refunded, fraudulent, or otherwise invalid orders do not qualify for Referrer Rewards.

A partial refund does not automatically invalidate a referral solely because the remaining order falls below a particular value, since the Program has no minimum purchase requirement.

Where a purchase becomes ineligible after a reward has been issued, we may revoke an unused reward or take other appropriate measures permitted by law.

6.2 Exceptional Review of Unattributed Referrals

We are not obligated to automatically credit purchases completed without the required Referral Code.

However, where a genuine referral occurred before a purchase but the Referred Customer used another non-combinable promotional code, the Referrer may contact Customer Service.

We may review supporting information and determine whether an exceptional reward is appropriate.

Such adjustments are discretionary, are not guaranteed, and do not permit promotional discounts to be combined.

7. Discount Combinations and Exclusions

Friend Discounts and Referrer Rewards cannot be combined with other promotional discounts unless expressly authorized by Whisper of Botanicals.

This restriction includes:

Other referral discount or reward codes.
Welcome offers and newsletter signup discounts.
Influencer, affiliate, and social media promotional codes.
Seasonal and limited-time promotions.
Automatic product or order discounts.
Discounts associated with skincare routine bundles or DIY product bundles.
Other promotional free-product offers.
Promotional shipping discount codes.

Only combinations expressly authorized and supported at checkout may apply.

Standard product prices, ordinary shipping rates, and standard free-shipping thresholds remain subject to the Site's applicable pricing and shipping policies.

Customers should review their final checkout totals before completing a purchase.

Promotional discounts are not generally applied retroactively because a customer forgot a code, selected another offer, or could have qualified for a different promotion, except where required by applicable law or expressly approved by us.

8. Responsible Sharing and Public Promotion

The Program is intended to encourage genuine, responsible recommendations.

Referrers may share their Referral Links:

With friends, family, and people with whom they have an appropriate relationship.
Through their own personal or professional social media accounts.
Through public posts, stories, videos, or other content shared with their existing audience or community.

Public sharing on a Referrer's own social media account is permitted, provided the content complies with these Program Terms and applicable law.

Unsolicited prospecting of strangers and active solicitation of potential Whisper of Botanicals customers are prohibited.

Prohibited activities include:

Sending unsolicited direct messages to strangers promoting Referral Links or Codes.
Mass emailing, mass messaging, or sending repeated promotional invitations to people who have not requested them.
Posting targeted unsolicited promotional comments on social media.
Individually soliciting followers of Whisper of Botanicals or other brands without an appropriate prior relationship or permission.
Using purchased, scraped, harvested, or otherwise unauthorized contact lists.
Posting Referral Codes on coupon aggregation or discount-code distribution websites without authorization.
Running paid advertisements or other commercial acquisition campaigns promoting Referral Links without our prior written authorization.
Making misleading claims or implying official authorization by Whisper of Botanicals.

Public sharing does not authorize unsolicited direct outreach to individual users.

Referrers who publicly promote the Program must clearly disclose that they may receive a discount or other benefit when their recommendations result in qualifying purchases.

All sharing and invitations must comply with applicable advertising, privacy, consumer protection, and anti-spam laws.

8.1 Enforcement

Violations may result in the immediate suspension of referral rewards and exclusion from the Program.

Depending on the seriousness of the conduct, we may suspend Program access, cancel improperly obtained unused rewards, restrict future participation, or permanently exclude the participant.

Immediate protective measures may be taken where reasonably necessary to stop ongoing unsolicited solicitation, fraud, or abuse.

Any enforcement action is subject to applicable law. Affected participants may request a review through Customer Service.

9. Fraud Prevention and Prohibited Conduct

The following activities are prohibited:

Self-referrals, including referrals made through multiple accounts, email addresses, or identities.
Creating fictitious customers, orders, or referral transactions.
Using another person's personal information without authorization.
Circumventing first-time-customer or existing-customer eligibility requirements.
Using bots, automated scripts, or artificial methods to generate referrals.
Manipulating orders, cancellations, returns, refunds, or chargebacks to obtain rewards improperly.
Selling, transferring, or commercially distributing reward coupons.
Interfering with referral tracking, discount attribution, or Program systems.
Engaging in other fraudulent, misleading, or unlawful activity related to the Program.

We may investigate suspicious activity using reasonably necessary account, order, payment, delivery, and technical information.

Sharing a household, IP address, or internet connection does not automatically establish fraud. Such situations may be assessed individually.

Where we reasonably determine that fraud or abuse has occurred, we may refuse or revoke improperly obtained rewards, restrict access, or take other lawful measures.

10. Cancellations, Returns, and Refunds

All purchases remain subject to our Return & Refund Policy and applicable consumer protection laws.

A Referrer Reward depends on the associated Referred Customer's purchase remaining legitimate and eligible.

If an order is cancelled, fully refunded, or invalidated because of fraud or a chargeback, any corresponding pending reward may be denied or cancelled.

An already-issued, unused reward may be revoked where legally permitted.

A partial refund does not automatically invalidate a referral based on a minimum remaining purchase amount, since no minimum purchase threshold applies.

Nothing in these Program Terms limits any refund, replacement, warranty, or other remedy required by applicable law.

11. Referral Invitations and Electronic Communications

The Program uses automated email notifications to communicate information about invitations, discount claims, successful referrals, and earned rewards.

These may include:

Invitations sent to Referred Customers through the Program.
Confirmation emails containing a claimed Friend Discount.
Welcome emails sent to eligible Referrers.
Notifications informing Referrers that a reward has been earned.

Such communications are administered through Shopjar, Shopify, or other authorized service providers, where applicable.

Receiving a referral invitation does not, by itself, subscribe the recipient to the Whisper of Botanicals newsletter.

Submitting the Friend Discount claim form also registers the Referred Customer for the newsletter, as disclosed with that form and described in Section 4.1.

Simply registering as a Referrer does not, by itself, create a new newsletter subscription.

Newsletter communications may include marketing offers, product information, new releases, educational content, and other updates from Whisper of Botanicals.

Newsletter subscribers may unsubscribe at any time. Withdrawing from newsletter communications does not automatically terminate participation in the Program or invalidate a legitimately issued reward.

All electronic communications remain subject to applicable law and our Privacy Policy.

12. Program Changes, Suspension, and Termination

Whisper of Botanicals may modify, suspend, or discontinue the Program for legitimate commercial, operational, security, or legal reasons.

Changes will generally apply prospectively and will be communicated through the Site or another appropriate channel.

Future discount percentages, eligibility criteria, reward structures, and redemption rules may be changed.

Valid rewards already earned will not be arbitrarily cancelled or materially reduced retroactively, except where permitted or required by applicable law, including fraud, abuse, invalid transactions, or legitimate technical errors.

The 365-day validity period of an already-issued legitimate Referrer Reward will not be shortened solely because the Program is changed or discontinued, except where legally permitted or required.

Nothing in these Program Terms removes non-waivable statutory rights or remedies.

13. Privacy and Service Providers

The Program is administered through Shopify, Shopjar, and other service providers used to manage referrals, discount codes, electronic communications, and related operations.

We may collect and process information reasonably necessary to administer and protect the Program, including:

Names and email addresses.
Referral Links, Codes, and identifiers.
Discount claims and coupon redemption information.
Order details, purchase history, and transaction status.
Newsletter subscription status and communication preferences.
Relevant information used for security, verification, and fraud prevention.

When an eligible Referred Customer submits the reward claim form, their email address is used to process their discount request, administer the referral, deliver their promotional code, and register their newsletter subscription as disclosed in the claim form.

Newsletter communications and unsubscribe requests are managed in accordance with our Privacy Policy and applicable law.

Some service providers may process personal information outside Canada, subject to applicable privacy requirements.

The collection, use, disclosure, retention, and protection of personal information are governed by our Privacy Policy.

Participants may contact Customer Service to exercise applicable privacy rights.

14. General Provisions and Governing Law

The Program is available only to eligible participants and for purchases and deliveries supported within Canada.

These Program Terms are governed by the applicable laws of British Columbia and Canada, subject to mandatory consumer protection and other laws applicable in a participant's province or territory.

If any provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Our general Terms of Service & Sale govern matters not specifically addressed in these Program Terms.

Nothing in these Program Terms excludes or limits statutory warranties, refunds, remedies, liabilities, or consumer protection rights that cannot lawfully be excluded or limited.

These Program Terms are available in English and French and are intended to have equivalent meaning. All mandatory language and consumer protection requirements remain applicable, including those relating to Québec consumers.

The Program is a conditional promotional arrangement and does not involve a random draw, lottery, or prize contest.
